He delivered the message in the Guest Lecture “The Role and Challenges for MK in Achieving Democratic Law and Politics” held online and offline from FH UNS Hall and through the Zoom Cloud Meeting, Friday (3/12/2021).

“I reminded the Law students, never make law your commodity when you work as an advocate, notary, and other careers in the future. Do not put law practice on sale!” Prof. Arief stated.

Prof. Arief shared the reminder because, he explained, the legal system in Indonesia has its source on the God Almighty that is in line with the theocracy theory applied by Indonesia. The theory promoted by Thomas Aquino and Agustinus bases its legal system on God’s sovereignty. Meaning that fundamentally, a theocracy state belief that a country was established because of God, and therefore, their government must be run, and the law is developed by upholding God.

According to Prof. Arief, proof that Indonesia is a theocracy state can be observed in the Preamble to the 1945 Constitution that written: “By the grace of God Almighty…..”

Recognition of God is also written in the Preamble of every Law and MK ruling read in the proceeding. Prof. Arief believed that the recognition of God in the Preamble of the 1945 Constitution makes Indonesia be a liberated country and survive with its diversity to this day.

“Thus, the source of law in Indonesia is not secular. The desire of the Indonesian people to be free and establish a country was achieved with the Grace of God Almighty. This is a religious nation so that I stated, the source of power in Indonesia is from the theocracy theory,” he added.

He gave an example of his time serving as the Chairman of MK in 2015-2017. Prof. Arief admitted that every time they read MK rulings in proceeding with the other eight MK judges, they also asked for forgiveness from God if their rulings had any shortcomings.

“My personal experience and Chairman of MK, when reading the ruling, in my heart, because I am a Muslim, always asked for forgiveness and apologized if the nine judges in MK in deciding, make a mistake,” he concluded. Humas UNS

The 2^nd place was won by Slamet Wiyono, Blulukan Village Chief, Colomadu, Karanganyar District, and 3^rd place was won by Ardita Devi Mayasari, Pulisen Village Chief, Boyolali, Boyolali District. In the running up line-up, the 1^st runner up was Suparmanto, Slogoretno Village Chief, Jatipurno, Wonogiri District, 2^nd runner up was Tri Prasetyo Utomo, Srimulyo Village Chief, Gondang, Sragen District.

In the competition initiated by the Faculty of Law (FH) UNS in collaboration with MK, participants were asked to send an oration video in the first elimination round. From 275 participants who sent their videos, the participants went through numerous other stages before the Best Five were selected to compete in the final round. The finalists were asked to deliver a 10-minutes speech in front of the juries: Secretary-General of MK, Prof. M. Guntur Hamzah; Rector of UNS, Prof. Jamal Wiwoho; Dean of FH UNS, Prof. I Gusti Ayu Ketut Rachmi Handayani; jury from Universitas Tarumanegara, Dr. Tundjung Herning Sitabuana; and Professor in Universitas Islam Indonesia Prof. Ni’matul Huda.

The final and closing ceremony was also attended by the Chairman of MK, Dr. Anwar Usman; Vice-Chairman of MK, Prof. Aswanto; Secretary-General of MK, Prof. M. Guntur Hamzah; Rector of UNS, Prof. Jamal Wiwoho; Dean of FH UNS, Prof. I Gusti Ayu Ketut Rachmi Handayani; Vice-Mayor of Surakarta, Drs. Teguh Prakosa; and Karanganyar Regent, Drs. Juliyatmono, M.M.

Prof. Jamal stated that changes in the constitution are possible due to the changes in the political, legal, security, economy, and other fields. These changes make every government policy need to be socialized, and the community from all walks of life needs to be educated. This is where Village Chief’s role comes to play in shaping people’s law and constitutional awareness.

“Therefore, it is appropriate and laudable if all village chiefs in Indonesia, in turns, received a briefing on the state constitution,” Prof. Jamal mentioned in his opening remark.

The Vice-Chairman of MK, Prof. Aswanto, also appreciated all finalists and winners in the competition. He also hoped that they could become the main role model in the community.

“MK welcomed the idea of constitution speech competition because MK needs to present in socializing the citizen’s constitutional rights. Once again, congratulation to all participants and winners,” Prof. Aswanto stated. Humas UNS

During his visit, Guntur Hamzah was accompanied by the Dean of FH UNS, Prof. I Gusti Ayu Ketut Rachmi Handayani, and Vice-Rector for Academic and Student Affairs UNS, Prof. Ahmad Yunus. Guntur Hamzah stated that the facilities and infrastructures in UNS are appropriate.

“Alhamdulillah, the buildings are okay, and we do not need to prepare many things. The prepared facilities are excellent, from the lighting, cooling system, stage, are good, what left is the final touches,” he stated.

He explained that this review aims to ease his part in preparing a design for the grand final early next month.

“Hopefully, this event will run well, considering it is getting closer. Hopefully, it will benefit all Village Chiefs in Solo Raya,” he hoped.

The Chief of the Organizing Committee, Dr. Agus Riewanto, explained that currently, the selection process has started. All participants were asked to send a video to the organizing committee, who will select 70 best participants for an offline meeting, then select the Best 15 before selecting the Best 5. The Best 5 participants will compete in the final round on 4 December in UNS.

“Hopefully, it becomes a national pilot project and could be developed as a special characteristic of FH UN to hold special speech competition in building the constitution and awareness on the constitution,” Dr. Agus concluded.

The final round is scheduled to be attended by the Chairman of MK, Dr. Anwar Usman, and the Mayor of Surakarta, Gibran Rakabuming Raka. Humas UNS

Responding to the plan, the Constitutional Law Expert (HTN) of the Faculty of Law (FH) Universitas Sebelas Maret (UNS) Surakarta Dr. Agus Riewanto, stated that KPU needs to be prepared for all risks of collective election 2024. His particular concern is the increase in the number of casualties from Voting Organizers (KPPS) caused by fatigue that occurred in 2019.

“Because there is no revision on Law No. 7 of 2017, I am worried that the issue in the 2019 election will re-occur in the 2024 election. So, if we want to predict the 2024 election, we could observe from the 2019 election,” Dr. Agus Riewanto stated in Nge-HIK “The Efforts to Manage Complexity of General Election and 2024 Election” on Thursday (11/11/2021).

In the event held by KPU Surakarta through the Zoom Cloud Meeting, Dr. Agus Riewanto also shared his evaluation of the 2019 election, including the absence of revision on Law No. 7 of 2017 regarding General Election, PKPU creativity in designing general election technical matters, proportional results based on majority rule, and expensive costs that will be incurred.

“In preparing the technical parts of the general election, PKPU could add aspects that are not appropriate in 2019 and improve it in 2024. Usually, there is a revision on General Election Law nearing the election, but today, we did not have it,” he explained.

Dr. Agus Riewanto suggested that national and local government elections should be held separately with an interlude of 2.5 years so that the populace will not be focused only on President and Vice-President election but also observe the election for DPR, DPD, and DPRD members. He also considers that five ballots and five ballot boxes for 2024 will be challenging for constituents and for the managing committee. “Thus, it needs to be simplified,” he added.

He emphasized the open proportional system adopted by Indonesia as the best approach because it allows political parties to develop, benefitting Indonesia as a democratic country. Besides considering the diversity of the Indonesian population.

“Generally, in countries with multiple religions, ethnics, and races, creates a proportional system shaped from all interests aspirations, so that there is no party that holds a single control (over the government), but parties have room to gain access in legislative institutions,” he concluded. The village has a prospective tourism destination that offers the natural beauty of the foot of Lawu Mountain, The Lawu Fresh. However, the destination has not offered significant differentiation from other tourism destinations. Puntukrejo Village also has Micro, Small, and Medium Enterprises (MSMEs) potential that has not been optimally developed due to the challenges in the marketing process and branding through its simple packaging.

Concerned with this condition, a student team from the Faculty of Law (FH), Universitas Sebelas Maret (UNS) Surakarta, had the initiative to develop the MSMEs and tourism destination in the village. Their community service program was implemented by the members of Student Association for Study and Research (KSP) Principium: Muhammad Ainurrasyid Alfikri, Aditya Tri Wijaya, Aldi Rizki Khoiruddin, Alizza Khumaira Assyifa, Hanif Alwan Mumtaz, Ika Putri Wijayanti, Jelita Kristi Agape, Petrus Kanisius Eko Kristanto, Ragil Listyaningrum, Widyasari Rizki Ananda Rahmadewi, and Yusriel Bachrie.

The program was a part of the Holistic Village Development and Empowerment Program (PHP2D) funded by the Directorate General of the Belmawa Ministry of Education, Culture, Research, and Technology (Kemdikbudristek). The program was also the implementation of the higher education Tri Dharma and Merdeka Belajar program that tries to implement independent learning through a direct project in the community.

The program titled Indian’s Lawu and MSME Edutour in Puntukrejo Village was officially launched on Tuesday (27/20/2021) in HIK Lawu, Karanganyar. The launch ceremony was attended by the Head of Tourism, Youth, and Sports Office of Karanganyar District, Drs. Titis Srijawoto mentioned support for the students and village government in his opening remark. He also hoped that UNS students would continue to have a high spirit in building a partnership in developing the village. “Including village potentials such as the tourism potential,” he stated.

The ceremony was also attended by the Vice-Dean for Planning, Partnership, Business, and Information Affairs FH UNS, Dr. Isharianto, S.H., M.H., who shared how delighted he is with the development of the village and his supports for students and their partner village. “We always support PHP2D Team FH UNS because this event is a part of Merdeka Belajar promoted by the Minister of Education, Culture, Research, and Technology,” he stated.

Before the launching ceremony, the Team, Ngargoyoso Village government, MSMEs, Village-owned business (Bumdes), Jeep group, and other village elements had worked together for four months. During the process, the Team held business and marketing training in the 4.0 digital era with all MSMEs in the Puntukrejo Village government. Under the supervision of Dr. Muhammad Rustamaji S.H. M.H. and Rysca Indreswari S.Pt., M.Si., the Team also has successfully integrated the tourism and MSMEs in Puntukrejo into Edutour MSMEs that combine the jeep and MSMEs’ production potential. The Team maintains close communication among the related parties and promotes the Edutour program through a creative video shared on various social media such as YouTube, Instagram, and Tiktok.

Indian’s Lawu is creative and educative camping in The Lawu Fresh, which has been visited by many tourists to take pictures with Indian-related background. This creative tourism program is then integrated into a tourism package.

Besides the launching ceremony, the event also included an MoU signing ceremony between the Team and the Tourism, Youth, and Sports Office of Karanganyar District and collaboration between FH UNS and the Ngargoyoso Village government. The participants in the event were also entertained with local ‘tek-tek’ music and Indian dances from the local children. Humas UNS
