UNS — The Academic Senate of Universitas Sebelas Maret (UNS) Surakarta hosted a Webinar entitled ‘Medical Doctor Profession and Medical Innovation’ through Zoom Cloud Meeting on Saturday (23/4/2022). Led by Prof. Ari Natalia Probandari, dr., M.P.H., Ph.D., the Head of Doctoral Program in Public Health Sciences, as Moderator, the webinar reviewed the Medical Doctor and Physician profession, including treatment innovation from an ethical and legal perspective. Three speakers were invited to the webinar, including Dr. Beni Satria, S.Ked., M.Kes., SH, M.H., CPMed., CPArb., CPCLE., Chairman of the Bureau of Legal Development and Member Defense (BHP2A) PB IDI; Dr. dr. J. B. Prasodjo, Sp.Rad(K)., Head of Radiology Department for the Faculty of Medical Science UNS and RSUD Dr. Moewardi Surakarta; as well as Dr. Arief Suryono, SH, M.H.

This event was also attended by the Rector of UNS, Prof. Jamal Wiwoho, SH, M.Hum., the Leaders of MSA PTNBH from all across Indonesia, and the Leaders of the UNS Academic Senate Commission. “Once again, this topic is important for all of us. Let’s support innovation created in medical treatment carried out by fellow physical. This medical innovation does not constitute a threat to the progress of the Medical Doctor profession in Indonesia or signal the death of the profession thereof. Instead, innovation is necessary, considering the rise of new health cases almost every year. I would like to express my deepest gratitude and appreciation to the UNS Academic Senate for organizing this activity and letting us understand the significance of the Medical Doctor profession in fostering medical treatment innovation in the interests of public health,” said Prof. Jamal in his speech.

The Chairperson of the UNS Academic Senate, Prof. Dr. Adi Sulistiyono, SH, M.H., conveyed the background of this event through his speech. This initiative started from the widely circulated decision of the Indonesian Association of Doctors (IDI) on March 25, 2022, officially dismiss the former Minister of Health of the Republic of Indonesia, Prof. Dr. dr. Terawan Agus Putranto, Sp. Rad(K)., as a member of IDI in the 31st IDI National Assembly in Banda Aceh. “The UNS Academic Senate considers that this activity is needed to allow us to review this case objectively, thus letting us take a good and just policy measures, in accordance with the applicable rules in the future, especially among the profession of Medical Doctor at UNS,” said, Prof. Adi.

Starting the material presentation session, Dr. Beni said that Medical Doctor Oath had been delivered since 250 BC in an inscription in the Valley of Mesopotamia, Babylon. One of the rules in the inscription states that a doctor will lose his hand if the patient who is being treated dies. The inscription has set the duty of a Medical Doctor to perform the treatment to the fullest extent.

“It has been mandated in the 1945 Constitution Article 28 H, Paragraph 1, concerning the Right to Obtain Health Services, where the right to health is a human right. Indonesia recognizes this right for anyone to obtain the highest standard in health service, hence, the standard provided should not be minimal or even medium. Health care must be delivered following the highest quality standard, therefore, the treatment can heal each person’s physical and mental health,” he explained. This suggestion is in line with the establishment of the Medical Practice Law in 2004, which states that the implementation of Medical Practice is a health service that must be carried out by doctors and dentists who hold a high code of ethics and morality.

Dr. Prasodjo as the second speaker, argued that from the beginning, this profession could be considered as an academic professional. “When a Doctor carries out his profession, they must innovate to nurture further development for the medical study itself. For example, how to treat someone better, how to find new ways of treating new diseases to benefit the community,” he said.

Some innovations that a doctor can make include discovering new diagnosis models under a new method and finding new therapy procedures. However, Dr. Prasodjo added that finding a new therapy technique is not an easy innovation. Because therapy is related to applied science whose object is human, thus, making it becomes difficult to do and requires high responsibility.

The last speaker at the event, Dr. Arief conveyed the legal view of the relationship between a medical doctor or physician and the patient. “The relationship between a physician and the patient is a legal relationship based on agreements, approvals, transactions, informed consent, and laws and regulations that have consequences on the physicians’ profession responsibility, namely ethical responsibility, discipline, and legal responsibility,” he concluded.

Dr. Arief also explains about 2 (two) types of agreements, namely inspannings verbintenis or effort agreement which means that both parties promise to make maximum efforts to realize what was promised and resultaat verbintenis or agreement that the promising party will provide a resultaat, which is a real result that is in accordance with what was promised. “Agreements between Physicians and patients in general include inspannings verbintenis or effort agreements. Based on this agreement, a Medical Doctor is obliged to deliver maximum health care efforts by mobilizing all his abilities and attention in accordance with professional standards, professional service standards, operational procedures standards, professional ethics, and patient health needs,” added Dr. Arief.
