UNS<\/strong> \u2013 The plan of the House of Representative (Dewan Perwakilan Rakyat<\/em> – DPR) to continue the Omnibus Law session amid the Coronavirus Disease 2019 (Covid-19) pandemic generates criticism from various parties.<\/p>\n

The criticism came from workers who consider DPR to hurt workers who is experiencing poor condition due to the COVID-19 pandemic.<\/p>\n

Seeing the wave of protest from various parties, both from the civilians and labors on DPR plan to proceed with Omnibus Law process, the expert of Constitutional Law (HTN) Universitas Sebelas Maret (UNS) Surakarta, Dr. Sunny Ummul Firdaus, stated that the Omnibus Law process by DPR have to fulfill a number of principles in the drafting of laws and regulations in Indonesia.<\/p>\n

\u201cIn the discussion process of Omnibus at the parliament is the same, there is no difference from the legal drafting process of law in general which is often discussed by DPR. If the process is the same, thus, the basis that is used must be the same, the principles must also be the same. If we talk about the basis determined in Article 5 Law Number 12 of 2011 whatever the laws and regulations must have a clear purpose,\u201d Dr. Sunny stated.<\/p>\n

This is conveyed by Dr. Sunny as a speaker in \u2018Law Discussion Room\u2019 held by Study and Research Group (Kelompok Studi dan Penelitian –<\/em> KSP) Principium Faculty of Law (FH) UNS, Saturday (9\/5\/2020). Dr. Sunny who is also the Chief of Democracy and National Resilience Study Center (Pusat Demokrasi dan Ketahanan Nasional –<\/em> Pusdemtanas) the Institute of Research and Community Service (LPPM) UNS mentioned that paying attention on the suitability between types of hierarchy and material content in criticizing the Omnibus Law is a very important note.<\/p>\n

\u201cIn my view, Omnibus Law this can only be used is the level of the Act. The next principle is the fit between the type of hierarchy and material content. This should be noted if we want to criticize the Omnibus Law. We must not compile a statutory regulation which in fact cannot be implemented. If it can be implemented, to what extent is its use for the community. If it is not useful why is it compiled?\u201d continued Dr. Sunny.<\/p>\n

To understand the extent of Omnibus Law usefulness to the society, both at the economic and legal sectors, Dr. Sunny asked the government and DPR to be transparent during the discussion of Omnibus Law. This will answer the openness principle which is mentioned in Article 5 Law Number 12 of 2011.<\/p>\n

In implementing the openness, the community is expected to play an active role in providing suggestion on Omnibus Law drafting in DPR. However, Dr. Sunny reminded that when providing input, it is necessary to ensure that the input submitted by the community is already accommodating all the interests of the community or lest it only accommodates certain community groups.<\/p>\n

\u201cThe community has a right to give an input, both oral and written, in order to improve the process of drafting the laws and regulations. By looking at academic texts, we can see the breath of legislation,\u201d she added.<\/p>\n

She also requested the DPR to give optimum participatory access to the community. If this cannot be fulfilled, Dr. Sunny firmly requested DPR not to continue the discussion of Omnibus Law further. In addition to answering the principles of openness and compatibility between types of hierarchy and material content, Dr. Sunny also gave a number of special notes to the DPR.<\/p>\n

\u201cIntegrating rights in the Omnibus Law is an important matter of how the principle of equal rights of men and women, non-discriminatory, the principle of the obligation of the state to realize equality of human rights in the civil, economic, social and cultural fields. Omnibus Law must also be free from evil intentions, moral hazards, and \u2018aji mumpung<\/em>\u2019 (taking advantage of \u2018while we are at it\u2019) from legislator,\u201d she concluded.
