UNS — The Faculty of Law (FH) Universitas Sebelas Maret (UNS) Surakarta Alumni Association (IKA) held the 11th Ngobrol Bareng IKA FH UNS (Chat with IKA FH UNS) on ‘Is Online Lending Dangerous?’ through the Zoom Cloud Meeting platform on Thursday (10/2/2022). The online event was attended by three speakers, Dr. Yudho Taruno Muryanto, S.H., M.Hum., FH UNS faculty member, Civil Law expert, and the Secretary of Institute of Educational Quality Assurance and Development (LPPMP) UNS, Irhamsyah, S.H., the Deputy Director of Financial Service Authority (OJK) Financial Services Industry and the Illegal Investment Investigation Task Force, and Kombes Pol Wiji Suwartini, S.H., S.E., M.H., Auditor Kepolisian Madya TK III Itwasda Polda Jatim (Police Auditor).
Representing the IKA FH UNS, Prof. Dr. Zudan Arif Fakrulloh, S.H., M.H., mentioned in his opening remark that online lending is a national issue with legal, psycho-social, and digital trust aspects. Therefore, he added that the issue could be solved through legal and financial aspects. “There needs to be an easy mechanism for people to borrow money, for example through cooperative. Or through the social safety net,” he stated.
Kombes Pol Wiji explained that the majority of online lending cases caused adverse impacts for the community, starting from an unethical collection process to a collection of lending that people are not aware of. She also explained that the case of violent debt collection is handled by Cyber Subunit at the provincial police office or the Criminal Unit at the lower police office. “The legal basis for the proceeding is UU ITE Article 27 paragraph 4 and Article 45 paragraph 4,” she added.
Kombes Pol Wiji also explained the difficulties of handling online lending cases because the tracking process involves foreign institutions and the verbal and psychological abuse inflicted on the victims need a specialist to screen. She also emphasized that although every report will be handled, law enforcement should become the last resort, and prevention should takes precedence.
Based on the legal license, there are 103 Fintech Lending registered and monitored by OJK. People could check the list of online legal lending in @ojkindonesia Instagram account or contact 157 telephone service. “There is four-course of actions suggested in online lending, first borrow to legal online lending monitored by OJK, borrow according to the needs and ability, borrow for productive needs because it will become a burden, and understand the benefits, timeframe, and risks,” Irhamsyah explained.
In general, online lending is a form of digital transformation from conventional lending that could ease the process of financial services. However, the rampant cases of personal identity theft and illegal sharing make Dr. Yudho argue that the limit between private and public data access is the key issue of the phenomenon. Humas UNS
