UNS — The Master in Notary Study Program, Faculty of Law (FH), Universitas Sebelas Maret (UNS) Surakarta organizes a national webinar on the “Improvement of Monitoring Function by the Notary Supervisory Council” through Zoom Cloud Meeting on Saturday (26/9/2020) morning. In this webinar, the study program specifically discuss the effectiveness of the Regulation of the Minister of Law and Human Rights (Permenkumham) No 15 of 2020 regarding Examination Procedures for the Supervisory Board Toward Notaries. Three speakers were invited to the webinar namely Dr. Bambang Rantam Sariwanto (General Secretary of the Ministrial of Law and Human Rights RI), Dr. Winanto Wiryomartani (Deputy Chairman of the Notary Central Supervisory Council RI), and Dr. Albertus Sentot Sudarwanto (FH UNS Faculty Member).
Opening the webinar was the Dean of FH UNS, Prof. I Gusti Ayu Ketut Rachmi Handayani, who appreciates the Master in Notary Study Program FH UNS that has prepared the national webinar appropriately. “Thank you to the committee members, for all of the efforts, and congratulation to the study program for its excellent accreditation from the BAN-PT,” Prof. Ayu states.
As the first speaker, the Deputy Chairman of the Notary Central Supervisory Council RI, Dr. Winanto Wiryomartani, discuss the legal entanglement for notaries who did not perform their functions properly. He states that notary as noblese oblige must prepare a perfect authentic deeds for the benefit of clients in need. “The monitoring on notary profession includes notary’s behavior and compliance in carrying out their profession according to Article 67 paragraph (5) of the Law on the Notary Department (UUJN). The error in implementing their profession can result in claim for damages up to the criminal lawsuit,” Dr. Winanto explains.
Completing Dr. Winanto, the General Secretary of the Ministrial of Law and Human Rights RI, Dr. Bambang states that the existence of Notary Supervisory Council as regulated in Permenkumham No 15 of 2020, is established to carry out guidance and supervision of notaries. “This is not an easy. In fact, it can be quite tough. Coaching and supervision toward notary profession must be carried out throughout Indonesia, totaling 17,856 across regencies/cities,” Dr. Bambang reveals. The coverage of this Permenkumhan, Dr. Bambang added, is significant. It means the Permenkumham No 15 of 2020 become the guidelines for all Notary Supervisory Council in implementing their duty and authority, both at Local Examiner Council, Regional Examiner Council, and Central Examiner Council.
The last speaker, Dr. Sentot delivers material on ‘Implication and Problems in the Notaries Audit By the Regional Examiner Council’. He states that notary has an important roles and authorities for the legal traffic in social life. Further Dr. Sentot mentioned matters that are prone to abuse that can cause harm to society, guidance, and supervision of notaries must be carried out effectively. “Because there are reports from the community members regarding sale and purchase of houses and land, whose certificate is declared by a public notary owned by someone, thus creating a disadvantage for the society,” Dr. Sentot said.
